1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and musen, the operator of the musen platform ("musen", "we", "us", "our"). These Terms govern your access to and use of the musen platform, including the website available at https://musen.live, any associated mobile or desktop applications, and all related services, features, tools, and content (collectively, the "Service").

These Terms apply to all individuals who access or use the Service, including users who access the Service without creating an account ("Guests") and users who register an account.

By accessing or using the Service in any manner, including by clicking the "Enter" button on the landing page, creating an account, signing in with an available authentication method, or using any functionality of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

You represent and warrant that you are at least thirteen (13) years of age. The Service is not intended for, and may not be used by, individuals under the age of thirteen (13). musen does not knowingly permit children under thirteen (13) to access or use the Service.

If you are at least thirteen (13) years old but have not reached the age of legal majority in your jurisdiction, you may access and use the Service only where permitted by applicable law and, where required, with the consent, authorisation, or supervision of a parent or legal guardian. By accessing or using the Service, you represent and warrant that any required parent or legal guardian consent or authorisation has been obtained.

Certain features may be unavailable in the current release of the Service or may be restricted for Users who have not reached the age of legal majority in their jurisdiction or who do not satisfy additional eligibility requirements.

Your access to and use of the Service is also subject to our Privacy Policy, which describes how personal data is collected, used, and protected. The Privacy Policy forms an integral part of these Terms and should be reviewed carefully before using the Service.

2. Definitions and Interpretation

2.1 Interpretation

Words with capitalized initial letters have meanings defined in these Terms. Unless the context otherwise requires:

Words in the singular include the plural and vice versa.
References to a gender include all genders.
References to persons include natural persons and legal entities.
Headings are included for convenience only and do not affect interpretation.

2.2 Definitions

For the purposes of these Terms:

Application means any software application provided by musen to access the Service, whether via web, mobile, or other devices.
Service means the Application, the website available at https://musen.live, and all related features, tools, content, and services provided by musen.
User means any individual who accesses or uses the Service, whether as a Guest or as a registered account holder.
Guest means a User who accesses the Service without creating an account or signing in.
Minor means a User who is at least thirteen (13) years old but has not reached the age of legal majority in their jurisdiction.
Parent or Legal Guardian means a person with legal authority to consent to, authorise, or supervise a Minor's use of the Service where required by applicable law.
Authentication Provider means a third party service used to authenticate a User account, including Google authentication, Apple authentication, or any other authentication method supported by musen.
AI DJ means musen's automated, non conversational curation system that selects, sequences, and adapts audio content for continuous listening based on system logic, user interactions, and contextual signals.
Live AI Radio means a continuous, dynamically generated radio stream assembled in real time by automated systems.

3. Scope and Nature of the Service

musen provides an AI powered radio platform designed to deliver a continuous, adaptive listening experience for entertainment purposes only. The Service enables Users to listen to radio streams that are automatically curated, sequenced, and adapted by the AI DJ, to control playback, and to manage personalization settings and their account.

The current release of the Service is listening only. It does not include content creation tools, audio uploads, public broadcasting by Users, discovery or search pages, virtual credits, downloads, commercial usage rights, or paid features. musen may introduce additional features over time; where new features materially affect these Terms, musen will provide updated Terms in accordance with the section on changes to these Terms.

The Service is not directed to children under thirteen (13) years of age. Certain features or content may be unavailable or restricted for Minors or for Users who do not satisfy applicable eligibility requirements.

The Service operates as a technical and creative platform. musen does not act as a publisher, broadcaster, editor, journalist, advisor, or fiduciary. musen does not exercise human editorial control over the selection, sequencing, or generation of audio content and does not endorse, verify, or assume responsibility for any content made available through the Service.

All audio content provided through the Service, whether generated, curated, or presented automatically, is offered on an "as generated" basis. musen makes no representations or warranties regarding the accuracy, completeness, quality, reliability, legality, age suitability, or fitness of any content, and such content must not be relied upon as factual, journalistic, legal, medical, financial, or other professional advice.

musen does not guarantee that the Service, or any specific feature, content, or functionality, will be available at any given time or without interruption. Access to the Service may be limited, suspended, or affected by technical issues, maintenance, capacity constraints, age eligibility requirements, platform provider requirements, or external factors beyond musen's control.

musen reserves the right, at its sole discretion and subject to applicable law, to modify, suspend, restrict, or discontinue all or any part of the Service, including features, content availability, eligibility requirements, authentication methods, or usage limits, at any time and without liability to Users.

4. Automated and Non-Editorial Operation

The Service operates as an automated media system. Audio content made available through the Service is generated, selected, sequenced, and adapted by automated processes, including algorithmic and artificial intelligence based systems, without real-time human editorial intervention.

musen does not employ human editors to curate, approve, review, or control individual audio content or streams prior to delivery to Users. Any spoken or musical content presented through the Service is produced or assembled automatically in accordance with system logic.

Human involvement in the operation of the Service is limited to the design, development, configuration, and governance of system-level rules, constraints, parameters, and safeguards. Such human involvement does not constitute editorial control over specific content and is intended to ensure lawful operation, technical reliability, and alignment with the intended purpose of the Service.

The Service does not perform automated decision-making that produces legal effects concerning Users or similarly significantly affects Users within the meaning of applicable data protection or artificial intelligence laws. Automated processes are used solely to provide entertainment experiences and do not determine Users' legal rights, obligations, or access to essential services.

5. Eligibility and Geographic Availability

You may access and use the Service only if you meet the eligibility requirements set out in these Terms and all applicable laws.

You represent and warrant that you are at least thirteen (13) years of age. Individuals under thirteen (13) years of age may not access or use the Service.

If you are at least thirteen (13) years old but have not reached the age of legal majority in your jurisdiction, you may access and use the Service only where permitted by applicable law and, where required, with the consent, authorisation, or supervision of a Parent or Legal Guardian. If applicable law in your jurisdiction requires a higher minimum age, additional consent, parent authorisation, legal guardian authorisation, or any other legal condition for access to online services, you may use the Service only if those requirements are satisfied.

musen reserves the right to request verification of age, eligibility, legal capacity, parent authorisation, or legal guardian authorisation where reasonably necessary or where required by applicable law. musen may restrict, suspend, or terminate access where it reasonably determines that a User does not satisfy applicable eligibility requirements or has misrepresented age, identity, or authorisation.

The Service may not be available in all geographic locations and may be restricted or prohibited in certain jurisdictions due to legal, regulatory, platform provider, or operational considerations. musen makes no representation that the Service is appropriate or available for use in any particular location.

You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to comprehensive trade sanctions or embargoes, and that you are not listed on any applicable government restricted or denied party lists. You agree not to access or use the Service in violation of export control, sanctions, or trade compliance laws of the European Union, the United States, or any other applicable jurisdiction.

You are solely responsible for ensuring that your access to and use of the Service complies with all local, national, and international laws and regulations applicable to you. musen shall not be liable for any access to or use of the Service that is not in compliance with applicable law.

musen reserves the right, at its sole discretion, to limit, suspend, or terminate access to the Service in any jurisdiction or for any User where necessary to comply with legal requirements or to mitigate legal, regulatory, safety, platform provider, or operational risk.

6. User Accounts and Responsibilities

Certain features of the Service require the creation of a user account. When creating an account, you agree to provide accurate, current, and complete information and to keep such information up to date at all times.

Users may create or access an account using supported authentication methods, which may include email and password, Google authentication, Apple authentication, or other authentication methods made available by musen. musen may add, remove, or modify supported authentication methods from time to time, subject to applicable law and platform requirements.

Where you use a third party Authentication Provider, such as Apple or Google, your use of that authentication method is subject to the terms, conditions, and privacy policies of the relevant provider. If you use Apple authentication, Apple may provide musen with a private relay email address or other limited account identifier depending on your Apple account settings. You are responsible for maintaining access to the third party account used to authenticate with musen.

You are solely responsible for maintaining the confidentiality and security of your account credentials, authentication methods, and access tokens. You agree not to share your credentials with any third party and to notify musen immediately of any suspected unauthorized access or security breach relating to your account.

You must not provide false account information, misrepresent your age, create an account on behalf of a child under thirteen (13), misrepresent parent or legal guardian authorisation, or use another person's authentication credentials without authorisation.

You are fully responsible for all activities conducted through your account, whether such activities are performed by you or by any third party with or without your authorization. musen shall not be liable for any loss, damage, or liability arising from unauthorized use of your account where such use results from your failure to safeguard your credentials, authentication methods, access tokens, or third party authentication accounts.

Guest users may access limited portions of the Service without creating an account. Guest access is provided on an "as available" basis and may be restricted, modified, or discontinued at any time. Certain features, content, or functionality may not be available to Guest users.

musen reserves the right to suspend or terminate accounts that contain inaccurate information, are used in violation of these Terms, fail to satisfy eligibility requirements, lack required parent or legal guardian authorisation, or pose security, legal, safety, or operational risks.

7. Free Service

The Service is provided free of charge. musen does not offer paid subscriptions, paid plans, virtual credits, or in-app purchases, and does not collect or process any payment data in connection with the Service.

No feature of the Service requires payment. Access to features may nevertheless be subject to eligibility requirements, age restrictions, usage limits, or other non monetary conditions as described in these Terms.

If musen introduces paid features in the future, such features will be governed by updated Terms, and musen will provide reasonable advance notice as required by applicable law, including information on pricing, billing, applicable consumer rights, and any age or authorisation requirements. No paid feature will be activated for an existing account without the User's explicit action.

8. Description of AI Functionality

The Service relies on automated systems, including artificial intelligence and algorithmic processes, to generate, curate, select, and sequence audio content, including through the AI DJ and Live AI Radio features. Such systems operate continuously and adaptively based on system logic, user interactions, and contextual signals.

You acknowledge and agree that AI generated or AI curated content is produced automatically and without human editorial review. musen makes no representations or warranties regarding the accuracy, completeness, reliability, appropriateness, age suitability, or fitness of any content generated, curated, or delivered through the Service. All such content is provided for entertainment purposes only.

The Service is not intended to provide, and must not be relied upon as providing, factual, journalistic, legal, medical, financial, or other professional advice. You are solely responsible for evaluating any content before relying on it for any purpose.

musen may apply age based safety settings, content availability limits, feature restrictions, moderation measures, or access controls where necessary to comply with applicable law, protect users, satisfy platform requirements, or preserve platform integrity.

The automated systems used by musen do not constitute a high risk artificial intelligence system within the meaning of applicable European Union artificial intelligence legislation. The Service does not perform biometric identification, biometric categorization, social scoring, or profiling that produces legal or similarly significant effects on Users.

9. Intellectual Property Rights

All rights, title, and interest in and to the Service, including without limitation the software, applications, source code, algorithms, models, workflows, systems, databases, user interfaces, design elements, audio processing techniques, and underlying technology, are and shall remain the exclusive property of musen or its licensors.

All audio content made available through the Service is generated, curated, or assembled by automated systems operated by musen and remains subject to musen's rights in the underlying technology, systems, and processes. Subject to compliance with these Terms, musen grants you a limited, non exclusive, non transferable, revocable right to access and listen to such content within the Service for personal, non commercial purposes. No other rights in such content are granted to you. You may not record, capture, download, extract, reproduce, redistribute, publicly perform, or commercially exploit audio content delivered through the Service, except as expressly permitted by musen in writing.

All trademarks, service marks, trade names, logos, and branding elements associated with the Service, including the name "musen", are owned by musen or its licensors. Nothing in these Terms grants you any right, license, or interest in or to such trademarks or branding, except for the limited right to use the Service in accordance with these Terms.

Except for the limited rights expressly granted to you to access and use the Service, nothing in these Terms shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use musen's intellectual property.

10. Acceptable Use and Platform Protection

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not engage in any activity that interferes with, disrupts, or harms the Service, its systems, or other Users.

Without limiting the foregoing, you agree not to, and not to attempt to:

Scrape, crawl, harvest, extract, copy, or otherwise collect data, audio, metadata, or other content from the Service at scale, whether manually or through automated means;
Record, rip, capture, download, or redistribute audio content delivered through the Service, except as expressly permitted;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, algorithms, or underlying systems of the Service;
Create, train, or operate derivative systems, competing services, or datasets using the Service or its outputs, except as expressly permitted in writing by musen;
Circumvent, disable, bypass, or otherwise interfere with usage limits, access controls, age restrictions, feature restrictions, technical safeguards, moderation measures, or security measures of the Service;
Create an account for, or assist access by, a child under thirteen (13);
Misrepresent your age, identity, legal capacity, parent authorisation, or legal guardian authorisation;
Solicit, collect, expose, publish, or misuse personal data of children under thirteen (13), Minors, or other Users;
Use Apple authentication, Google authentication, or any other authentication method fraudulently, without authorisation, or in violation of the applicable provider's terms;
Use the Service to exploit, endanger, harass, target, contact, identify, profile, or manipulate children, Minors, or vulnerable individuals.

Any violation of this section constitutes a material breach of these Terms and may result in immediate suspension or termination of access to the Service, without prejudice to any other rights or remedies available to musen under applicable law.

11. Content Reporting, Moderation, and Enforcement

musen is committed to operating the Service in compliance with applicable laws, including the European Union Digital Services Act, while preserving an open and creative environment for Users.

Audio content on the Service is generated and sequenced automatically. musen applies system-level rules, constraints, and safeguards designed to keep content lawful and appropriate for the Service's age rating. musen may use a combination of automated tools and human review to monitor the operation of these safeguards.

Users may report content they believe is unlawful, inappropriate for the applicable age rating, or otherwise in violation of these Terms through mechanisms or contact channels made available by musen. musen does not undertake a general obligation to monitor all content and does not guarantee that unlawful or inappropriate content will be identified or removed.

Where musen becomes aware of content or activity that violates these Terms or applicable law, musen may take appropriate enforcement actions, which may include removal or restriction of content, adjustment of system safeguards, limitation of features or functionality, suspension or termination of accounts, or referral to law enforcement or competent authorities where required by law. Enforcement actions are taken at musen's discretion, subject to applicable law, and may be applied immediately where necessary to address legal, security, safety, child protection, platform, or operational risks.

Where required by applicable law, musen will provide affected Users with a statement of reasons explaining any enforcement decision that materially affects the User, and Users may submit an appeal or request review of such decisions through procedures made available by musen. Where an appeal relates to a Minor, musen may require verification of the User's identity, age, or parent or legal guardian authority where required or appropriate under applicable law.

12. Copyright and Notice and Takedown

musen respects intellectual property rights. musen complies with applicable copyright laws, including the United States Digital Millennium Copyright Act ("DMCA") and relevant European Union copyright and notice-and-action frameworks.

If you believe that content made available through the Service infringes your copyright or other intellectual property rights, you may submit a written notice to musen containing sufficient information to allow musen to identify the allegedly infringing content and the basis of the claim. Such notices should include, where applicable:

Identification of the copyrighted work or right claimed to have been infringed;
Identification of the content alleged to be infringing and information reasonably sufficient to locate it;
Your contact information;
A statement that you have a good-faith belief that the use of the content is not authorized;
A statement that the information in the notice is accurate and, where required by law, made under penalty of perjury.

Notices may be submitted through contact details made available by musen. Upon receipt of a valid copyright notice, musen may remove or disable access to the allegedly infringing content in accordance with applicable law.

13. Third Party Services and Integrations

The Service may integrate with, rely upon, or provide access to third party services, platforms, tools, or content, including but not limited to application stores, hosting providers, analytics services, authentication providers, identity services, and external distribution platforms (collectively, "Third Party Services").

Third Party Services may include Apple, Google, the Apple App Store, the Google Play Store, hosting providers, analytics providers, monitoring providers, and other service providers used to operate or distribute the Service.

Your use of Third Party Services is subject to the terms, conditions, and privacy policies of the applicable third parties. musen does not control, endorse, or assume responsibility for any Third Party Services, including their availability, security, functionality, content, account access, age controls, parental controls, family sharing features, or data practices.

Where you register or sign in using Apple authentication, Google authentication, or another supported Authentication Provider, musen may receive limited account information from that provider, such as account identifier, email address, display name where provided, authentication tokens, and related login metadata. Where Apple authentication is used, Apple may provide musen with a private relay email address or limited account identifier depending on your Apple account settings.

musen shall not be liable for any loss, damage, interruption, account access issue, authentication failure, data handling issue, or harm arising from or relating to Third Party Services, including failures, errors, changes, restrictions, suspension, or discontinuation of such services.

Where the Service is accessed through an application store or platform operated by a third party, your use of the Service may also be subject to that platform's terms and conditions, which shall prevail in the event of any conflict with these Terms to the extent required by such platform.

14. Suspension and Termination

musen may suspend or terminate your access to the Service, in whole or in part, at any time, with or without prior notice, where musen reasonably determines that:

You have violated these Terms or applicable law;
Your use of the Service poses a legal, regulatory, security, safety, child protection, platform, or operational risk;
Your account is associated with suspected abuse, fraud, misuse, unauthorized access, or circumvention of safeguards;
You are under thirteen (13) years of age;
You have misrepresented your age, identity, legal capacity, parent authorisation, or legal guardian authorisation;
Required parent or legal guardian authorisation cannot be confirmed;
Your access through a Third Party Service or Authentication Provider is revoked, invalid, compromised, unavailable, or no longer supported;
Suspension or termination is required to comply with a legal obligation, platform provider requirement, or order.

In cases involving serious violations, legal risk, safety concerns, child protection concerns, security risks, or suspected circumvention of age restrictions, musen may take immediate action without prior notice. Where reasonably practicable and legally required, musen may provide notice of suspension or termination and an explanation of the reasons.

You may terminate your account at any time by discontinuing use of the Service or through account management tools where available.

Upon suspension or termination, your right to access and use the Service will immediately cease. musen may delete or restrict access to associated account data and content, subject to applicable law.

The following provisions shall survive suspension or termination of these Terms: Intellectual Property Rights, Acceptable Use and Platform Protection, Limitation of Liability, Disclaimers, Governing Law and Dispute Resolution, and any other provisions which by their nature should survive.

15. Disclaimers

The Service, including all audio content generated, curated, or delivered through automated systems, is provided for entertainment purposes only. The Service is not intended to provide, and must not be relied upon as providing, factual, journalistic, legal, medical, financial, or other professional advice.

You acknowledge and agree that content made available through the Service is generated or assembled automatically and may contain inaccuracies, errors, omissions, inappropriate material, unsuitable material for certain ages, or misleading information. musen makes no representations or warranties regarding the accuracy, completeness, reliability, timeliness, age suitability, or fitness of any content.

Any reliance you place on content accessed through the Service is at your sole risk. musen disclaims all responsibility and liability arising from any reliance on AI generated or AI curated content by you or any third party.

musen does not guarantee that all audio content made available through the Service will be suitable for every User, including every User aged thirteen (13) to seventeen (17). Users, parents, and legal guardians remain responsible for using available controls and assessing whether the Service is appropriate for their circumstances, subject to applicable law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, musen shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, loss of revenue, loss of data, loss of goodwill, or business interruption, arising out of or relating to your access to or use of, or inability to access or use, the Service.

To the extent that musen may be held liable notwithstanding the foregoing, the total aggregate liability of musen for any and all claims arising out of or relating to these Terms or the Service shall not exceed one hundred euros (EUR 100).

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable law, including mandatory consumer protection laws, or liability for death or personal injury caused by gross negligence or willful misconduct, where such exclusion or limitation is prohibited by law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless musen, its directors, officers, employees, contractors, affiliates, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to:

Your access to or use of the Service;
Your violation of these Terms or applicable law;
Any misrepresentation of age, identity, legal capacity, parent authorisation, or legal guardian authorisation.

If you are a Minor, the enforceability of this section may be limited by applicable law. Where a Parent or Legal Guardian authorises a Minor's use of the Service, that Parent or Legal Guardian may be responsible, to the extent permitted by applicable law, for the Minor's use of the Service and for claims arising from such authorised use.

musen reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with such defense. Your indemnification obligations shall survive termination of these Terms.

18. Accessibility

musen is committed to making the Service reasonably accessible to Users with disabilities and to improving accessibility over time in accordance with applicable laws and recognized accessibility standards.

Due to the evolving and complex nature of the Service, full accessibility across all features, content, devices, and assistive technologies cannot be guaranteed. Certain features or content may not be fully accessible in all circumstances.

musen welcomes feedback regarding accessibility and encourages Users to report accessibility issues through contact channels made available within the Service. musen will make reasonable efforts to review and address accessibility concerns where practicable.

19. Data Protection and Privacy

musen processes personal data in connection with the operation of the Service in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 ("GDPR").

Details regarding the categories of personal data collected, the purposes of processing, legal bases, data retention periods, user rights, authentication providers, child privacy safeguards, age eligibility processing, and data protection safeguards are set out in musen's Privacy Policy, which forms an integral part of these Terms.

By accessing or using the Service, you acknowledge that you have read and understood the Privacy Policy and that musen processes personal data as described in the Privacy Policy, subject to the legal bases, choices, safeguards, and rights described there. Acceptance of these Terms is not treated as consent to optional processing activities where separate consent is required by applicable law.

If you are a Minor, or if you are a Parent or Legal Guardian authorising a Minor's use of the Service, you acknowledge that additional age related privacy rules, consent requirements, authorisation requirements, feature restrictions, or safeguards may apply as described in the Privacy Policy.

Nothing in these Terms limits or overrides your rights as a data subject under applicable data protection legislation.

20. Governing Law and Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall be governed by and construed in accordance with the laws applicable to the operation of the Service, excluding conflict of law principles and without prejudice to any mandatory legal protections that apply to you.

If you are a consumer residing in the European Union, nothing in these Terms shall deprive you of the protection afforded to you by mandatory consumer protection laws of your country of residence. You may bring proceedings in the courts of your country of residence where such rights apply.

Nothing in these Terms limits any mandatory protections applicable to Minors, children, parents, legal guardians, consumers, or data subjects under the laws of their jurisdiction, where such protections cannot lawfully be waived or restricted.

Any disputes arising out of or relating to these Terms or the Service shall, in the first instance, be resolved through good faith negotiations between the parties. Where such negotiations do not resolve the dispute, and subject to mandatory consumer protection laws, disputes shall be submitted to the competent courts determined under applicable law.

musen reserves the right to modify, update, or replace these Terms at any time to reflect changes to the Service, legal requirements, platform provider requirements, authentication methods, age eligibility rules, child safety requirements, or business practices.

Where changes to these Terms materially affect your rights or obligations, musen will provide reasonable notice of such changes, including by posting the updated Terms within the Service or through other appropriate communication channels, as required by applicable law. Material changes may include changes to minimum age requirements, parent or legal guardian authorisation rules, authentication providers, or data protection related terms, or the introduction of content creation, social, discovery, or paid features.

By continuing to access or use the Service after updated Terms become effective, you acknowledge and agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.

23. Service Availability and Warranty Disclaimer

musen disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

24. Force Majeure

musen shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events beyond its reasonable control ("Force Majeure Events").

Force Majeure Events include, without limitation, acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, governmental actions, changes in laws or regulations, network or infrastructure failures, power outages, cloud service disruptions, failures of third-party service providers, or any other event outside musen's reasonable control.

During the occurrence of a Force Majeure Event, musen's obligations under these Terms shall be suspended to the extent and for the duration of the Force Majeure Event, without liability to Users.

25. Assignment

musen may assign, transfer, or otherwise dispose of these Terms, in whole or in part, without restriction, including in connection with a transfer of the Service, restructuring, sale of assets, or by operation of law.

You may not assign, transfer, or sublicense these Terms, in whole or in part, without the prior written consent of musen. Any attempted assignment or transfer in violation of this section shall be null and void.

These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

26. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified or severed to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

No failure or delay by musen in exercising any right, power, or remedy under these Terms shall operate as a waiver of such right, power, or remedy, nor shall any single or partial exercise of any right preclude any other or further exercise of such right or the exercise of any other right.

27. Entire Agreement

These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and musen regarding your access to and use of the Service and supersede all prior or contemporaneous agreements, understandings, representations, or communications, whether written or oral.

You acknowledge that you have not relied on any statement, promise, representation, or warranty not expressly set out in these Terms or the documents incorporated by reference.
